Adan files a report with the CNIL regarding data incidents involving public entities

Last March, ADAN sent a letter to the Ministry of Economy and Finance seeking clarification on several incidents involving data held by the tax authorities. This action was taken in particular following instances of unauthorized access to the national bank account database (FICOBA), as well as suspicions that a DGFiP official had disclosed confidential information regarding entities in the crypto-asset sector.

In the absence of a response to this initial request, Adanis continuing its efforts by filing a complaint with the National Commission for Information Technology and Civil Liberties (CNIL) to request an investigation into compliance with personal data protection obligations.

With the pro bono support of the law firm ORWL_, a member ofAdan, our association seeks clarification on the following:

➡️ The scope of the potentially compromised data and the identification of the individuals affected.

➡️ Compliance with the notification and information obligations set forth in the GDPR.

➡️ The security and access control measures implemented to prevent further incidents.

➡️ Consideration of the specific risks to which crypto-asset holders and their loved ones may be exposed, particularly with regard to physical security.

The protection of personal data is a critical issue for our industry. Beyond compliance with regulatory obligations, the confidentiality of this data directly contributes to the security of industry professionals and to trust in the institutions that process it.

Through this initiative, ADANreaffirms its commitment to better protecting stakeholders in the digital asset industry. We will continue to work with government agencies and the relevant authorities to advance the consideration of these issues.

We extend our warmest thanks to ORWL_, and particularly to Romain Chillyand Hugo Ferraris, for their commitment to working alongside us on this matter.
