Publication of the Decree on the Protection of Personal Information of Company Executives

On August 24, the Ministry of Justice issued a decree allowing business owners to request that their home addresses be kept confidential in the Trade and Companies Register (RCS).

In accordance with the proposals put forward by ADAN at the May 16 meeting at the Ministry of the Interior, attended by Bruno Retailleau, this decree now authorizes any executive or partner of a commercial enterprise to request that their personal address be withheld from the registry.
In practice, the request can be made through the one-stop shop, will be processed by the court registries within five business days, and only authorized authorities will have access to it in the course of their duties.

This important first step will be followed in the coming months by a bill proposed by Representative Paul Midy, which is expected before 2026. The bill will further strengthen the protection of executives by imposing stricter regulations on the dissemination of their personal data on platforms such as Pappers or Société.com.

The main measures included in the proposed bill:

  • The requirement for the INPI, Infogreffe, and INSEE to provide registries with documents from which personal addresses and other private information have been redacted.
  • The removal of personal data from documents that have already been published.
  • The option for business owners to hide their home address when it is the same as their business address.
